Pennsylvania Homebrew Law

Brewing your own beer at home has become a favorite activity of beer connoisseurs. Pennsylvania has laws about brewing beer, and they can be found in the Pennsylvania Liquor Control Board Liquor Code.

License

  • Brewing beer for profit without a license is illegal in Pennsylvania. You do not, however, need a license to home-brew beer if you do not sell your beer and you produce less than 200 gallons in a year.

Transport

  • It is against Pennsylvania law to transport beer in anything other than its original container. Therefore, you may not make a large batch of beer, bottle it and cross state lines to sell it in another state.

Composition

  • According to the Pennsylvania Liquor Control Board Liquor Code, any beverage that contains 0.5 percent or more alcohol by volume is a "malt or brewed beverage" and thus falls under state liquor laws.

Penalties

  • Violations of Pennsylvania liquor law are subject to fines of between $100 and $500. Failure to pay the fine may result in up to three months in prison plus further fines. Anyone found guilty of selling alcohol without a license may have to pay $2 per fluid ounce of each illegally sold beverage in addition to the previously mentioned fines.
