How much moonshine can be produced legally in us?

In the United States it is legal to produce moonshine or distilled spirits for household use as long as the producer obtains the proper license and follows the regulations. The federal law allows for the production of moonshine for personal consumption with a license from the Alcohol and Tobacco Tax and Trade Bureau (TTB) and complying with the regulations set forth in 26 U.S.C. 5042; 5052; 5179; and 27 CFR Part 19.

1. Licensing: To legally produce moonshine, you must obtain a permit from the TTB. There are two types of permits available:

- Basic Permit (Form 5110.22): Allows individuals to produce moonshine for personal consumption.

- Distiller's Permit (Form 5110.35): Allows individuals or entities to produce moonshine for commercial purposes.

2. Volume Limitations: The amount of moonshine you can produce legally varies based on the type of permit you have:

- Basic Permit: Allows for the production of up to 100 gallons of moonshine per year for personal consumption.

- Distiller's Permit: Allows for the production of moonshine for commercial purposes, but the amount is not limited as long as the producer adheres to the regulations and pays the required taxes.

3. Registration and Recordkeeping: Moonshine producers must register their stills with the TTB and keep detailed records of their production, including the type of equipment used, the amount of moonshine produced, and the disposition of the moonshine.

4. Taxes: The federal excise tax on distilled spirits is $13.34 per proof gallon. Moonshine producers must pay this tax before selling or distributing their products.

5. Labeling and Marketing: Moonshine must be labeled according to the TTB's regulations, which include information such as the name and address of the producer, the type of moonshine, and the alcohol content. Moonshine cannot be marketed as a cure for any disease or disorder.

6. Sale and Distribution: Moonshine can only be legally sold and distributed by licensed distilleries. It is illegal to sell or distribute moonshine without a license.

It's important to note that state and local laws may impose additional regulations or restrictions on the production and sale of moonshine. Therefore, it's crucial to research and comply with all applicable laws and regulations in your jurisdiction.
